Agreement of Terms & Conditions
This agreement sets out our responsibilities and commitment to you, as well as your responsibilities to us. This agreement creates a binding agreement between us, so please read it carefully. If you have any questions, we would be pleased to discuss them with you. This agreement is between the Talent or Parent/ Guardian of a Talent child under the age of 18 years, for and on behalf of Showcase Management Pty Ltd, Level 1, 127 Varsity Parade, Varsity Lakes, QLD 4227
This agreement must be accepted by the Talent or Parent/ Guardian (Talent under the age of 18) of a prospective Showcase Member in order for the membership to become valid. If the Talent and/or Parent/Guardian agrees to becoming a Member, this constitutes acceptance of this agreement.
TERMS & CONDITIONS – TALENT
All talent that would like to be represented by Showcase Management are required to have an online profile on an industry website specified by Showcase Management.
This allows more exposure to industry professionals creating greater work opportunities for all of our Talent.
This is an essential tool for Showcase Management to market its Talent to Clients, as all work submissions to Industry Clients are done electronically.
The profile allows us to provide clients with our talents Photos, Audio and Media files, along with experience and training information, ensuring our talent has the best opportunities for selection. The profiles are also beneficial to our talent as they can ensure their information is current and up to date, and they can make changes, add media and photos, and generate Comp Cards and CVs all at no additional cost.
The online profile has a one off set-up fee for $150.00 including GST (tax deductible),this fee is paid directly to the industry site, not to Showcase Management.
Showcase Management only charges a 10% fee of work supplied through our agency.
Health, Personal injury, loss or damage
We do not accept responsibility for any loss of, or damage to, personal property belonging to you. We do not accept liability for death or personal injury to any Talent attending job bookings or any activity related to a booking whether organised by Showcase Management or otherwise save to the extent that such injury shall be caused by the negligence or default of any member of our staff or any other default on our part.
Other losses - We do not accept responsibility for any loss or expense due to circumstances beyond our control, including, but not limited to, delays in public transport, weather, quarantine, sickness, bereavement, strikes or other industrial action, terrorism, fire and riot. Without prejudice to the other terms of this agreement, in no event (including our own negligence) will we be liable for any:
a) economic losses (including, without limitation, loss of revenues, profits, contracts, business or anticipated savings);
b) loss of goodwill or reputation;
c) any other special, indirect or consequential losses; or
d) loss to third parties.
e) consequential losses of any nature at all were incurred directly or indirectly by any activity with Showcase Management. This clause applies to the entire agreement and not just the agency portion and on all locations.
Termination Of Agency Agreement
Either the Talent or Parent / Guardian or Showcase Management may terminate this agreement, for any reason whatsoever, by the giving of 30 days notice in writing to the other party. Showcase may terminate this Agency agreement immediately by notice in writing to the Talent or Parent/ Guardian of Talent if the Parent, Guardian or the Member breaches this agreement.
In the event of termination, Showcase Management:
(i) is not obliged to refund any fees paid to third parties; including but not limited to Profiles, Photos, Training Courses and Workshops.
(ii) must deactivate and, if practicable, destroy all copies of the Member's information within its possession or control and may no longer act as the Member's agent and manager;
(iiI) within 30 days of the date of termination, pay any fees, less commissions, collected on the Talent’s behalf except to the extent that the Talent is in breach of this agreement and Showcase has collected fees on behalf of the Talent which relate to a booking in respect of which the Talent breached this agreement, in which case Showcase Management may retain those fees. Showcase Management or the relevant Client may take other action in response to the Talent’s breach of this agreement. All provisions of this agreement that are capable of continuing or which by their nature should continue, survive any termination of this agreement.
Special Conditions Relating To Child Employment
Under the legislation, Child Employment Act 2003, all children under the age of 15 years must have a Child Employment Permit for EVERY job. It is the responsibility of the client/employer & parent to have the permit in place. As the talent's Agent; we are happy to assist, however we are not legally allowed to submit the paperwork. Knowing what is required and allowing enough time for the documentation to be processed is essential.

SHOWCASE MANAGEMENT – CLIENT INFORMATION
No talent or any company supplying talent is an employee of Showcase Management. At no time is there an employer/employee relationship between Showcase Management and talent, Showcase Management acts solely as Agent for and on behalf of the talent. Accordingly, the Tax Department and the relevant Government Authorities, treat the booking contract as a contract of employment or services between the client who books the talent and the talent.
In accordance with the Australian Taxation Office “PAYG” withholding tax guidelines for Agents, performing artists, advertisers and advertising agencies available on the ATO website. The “Client” or Talent is deemed to carry all obligations and requirements regarding PAYG tax deductions from talent fees and the payment of superannuation contributions applicable in accordance with superannuation guarantee legislation. However authority maybe given to enable Showcase Management to handle the clients PAYG obligations and/or the clients superannuation responsibilities on their behalf. Giving authority to Showcase management does not extinguish the clients PAYG or superannuation obligations, or any other obligations that may arise under the talent/client relationship.
NOTE:The client can in no way correspond or deal with Showcase Management’s Talent directly in any form
WORKER’S COMPENSATION AND PUBLIC LIABILITY INSURANCES
It is the responsibility of the client to ensure that it is adequately covered for workers compensation and public liability insurances for the talent/model services. Showcase Management is in no way obligated to carry such insurances for talent.
USAGE, HOURS & RATES
Talent rates will be quoted and/or negotiated by Showcase Management separately within M.E.A.A .
Our Terms are strictly 14 days.
